NeON Arts

Spring 2020 Participant Registration

Free online NeON Arts workshops are open to young people ages 16–24 in New York City. Workshops will take place through online platforms such as Google Classroom and Zoom, and all necessary materials will be provided to participants. Explore the workshop descriptions and register by June 6. Workshop registration is available on a first-come, first-served basis. If you register for a workshop that is already at capacity, you will be notified via email and placed on a waitlist. Participants will receive a welcome email on May 29 with the full details for their workshop.

Intake Form / Limited Audiovisual Recording and Photography Release

In this program, the Participant (“you”) will be creating original creative work (e.g. music, dance, poetry, visual art, etc.) in workshops led by your designated arts provider (“Artist(s)”). You will own 100% of the rights to any creative work that you and the Artist(s) create during your participation in NeON Arts (the “Creative Work”). All rights to the Creative Work that Carnegie Hall and/or Artist(s) may have or acquire are hereby assigned to you.

You authorize Carnegie Hall to film, photograph, record, or display in any medium your Creative Work and to make audio, visual, audiovisual, photograph, film, and other recordings (the “Recordings”) of your voice, name, likeness, image, statements, performance and Creative Work (collectively, your “Appearance”) throughout your participation in NeON Arts at any rehearsal, workshop, performance, and/or other activity in which you participate. You hereby grant to Carnegie Hall and its affiliated and/or related entities, designees, successors, and/or assigns, in perpetuity, an exclusive, royalty-free, irrevocable, worldwide, right and license to create, modify, reproduce, store, copy, distribute, display, post, publish, adapt, exhibit, publicly perform, or otherwise use such Recordings of your Appearance in furtherance of its nonprofit mission, without compensation or further authorization.

Carnegie Hall will own all rights, title, and interest, including all copyrights, in and to the Recordings. If any such rights do not automatically vest in Carnegie Hall, you will and hereby do irrevocably and perpetually assign all right, title, and interest in and to them to Carnegie Hall. Carnegie Hall may edit the Recordings in any manner and Participant hereby waives any right to review and/or approve any use or edits of the Recordings. Participant understands and agrees that Carnegie Hall is not obligated to make or use the Recordings in any way. If Participant receives copies of the Recordings, Participant will not authorize their use by anyone else.

You agree that you are not entitled to any fees, payments, or other compensation resulting from Carnegie Hall’s use of the Recordings. You will not bring any claims relating to or arising from Carnegie Hall’s use of the Recordings, including without limitation any claims of defamation, invasion of privacy, or infringement of moral rights, rights of publicity, or copyright. You hereby forever release, discharge, and waive any and all claims of any kind whatsoever, whether known or unknown, that may arise from, are related to, or are in any way connected with the exercise of the permissions granted in this Release.

NeON Arts will be conducted through an internet-based third-party communication platform such as Zoom or Google Classroom, with the specific platform to be communicated to you by Carnegie Hall prior to the start of NeON Arts. You agree to use the specified platform for your participation in NeON Arts and to comply with the terms of use and all other applicable rules of the platform. Carnegie Hall will not be responsible for any claims arising from, and you will not bring any claims against Carnegie Hall related to, your use of the platform.

If any provision of this Release is determined to be invalid by a court of competent jurisdiction, such determination shall in no way affect the validity or enforceability of any other provision herein. This Release, when agreed to and submitted by you or, if you are under 18 years old, your parent or legal guardian, and all provisions contained herein, will be fully binding on you and your heirs, executors, administrators, and assigns. This Release expresses the complete understanding of the parties.

The person submitting this Release hereby affirms that they are either the Participant or, if the Participant is under 18 years old, the Participant’s parent or legal guardian, have read and understood this Release, fully understand and agree to its terms, and freely and voluntarily agree to it.
